Every week we read of cases where employers have been ordered to pay significant penalties where the disciplinary process followed has resulted in the employee taking personal grievance action claiming they have been unjustifiably dismissed or disadvantaged.
The law is very specific not only requiring justification for a disciplinary action but necessitating that the process followed was fair.
Failure in either, or both, the justification or disciplinary procedure can be both costly financially and damaging to the employer's reputation and public profile.
